1. Definitions
For the purposes of these terms and conditions:
Cracking or hacking means the unauthorized circumvention of user authentication services or other security services of any network, server, web server, or user account.
Denial of Service attacks means interference with the Service with respect to any user, network, or server.
Service means the provision to the client of access to data and information transmitted by DAGESH GROUP and its suppliers via the Internet, through this website, www.dageshgroup.com.
Trademarks refers to the fact that the denomination “DAGESH GROUP,” howsoever represented, including stylized representations, all associated logos and symbols, and combinations thereof with any word or graphic symbol used on this site, are registered trademarks of DAGESH GROUP or any affiliated companies.
2. DAGESH GROUP Obligations
2.1 DAGESH GROUP and its suppliers do not assume liability for any loss of data or information resulting from delays, unfulfilled orders, or orders that fail to reach their destination, caused by events beyond the control of DAGESH GROUP, its suppliers, or through errors or omissions on the part of the user. DAGESH GROUP and its suppliers disclaim any representation or warranty that:
a) the service will be uninterrupted or error-free
b) any defects will be remedied
c) the service, or the server that makes it available to users, is free from viruses or other components that could cause harm to users, and shall not be liable for any action you undertake based on such information or service.
2.2 Under no circumstances shall DAGESH GROUP be liable for any direct or indirect losses arising from or connected in any manner with the use or performance of the service, this website, or websites linked thereto.
2.3 DAGESH GROUP’s liability (if established by a court of law or arbitral tribunal), in respect of any act or omission or arising in any other manner from or in connection with the provision of services pursuant to this agreement, is limited in respect of each event or any series of connected events to USD $100 (one hundred US dollars).
3. Improper Use and Responsibilities
3.1 The Client agrees to use the service only for legal purposes. The Client undertakes to:
a) not modify, copy, distribute, transmit, display, publish, reproduce, license, create derivative works, transfer, or sell any information or services obtained from or through this website;
b) not engage in (and not permit) cracking or hacking activities, or denial of service attacks. Users who violate system or network security may face civil and criminal prosecution;
3.2 The Client agrees to indemnify and hold harmless DAGESH GROUP against any claim brought by a third party arising from the client’s use of the service or DAGESH GROUP’s communications network and the Internet, as well as in respect of any loss (direct, indirect, consequential, or otherwise), costs, actions, proceedings, claims, damages, expenses (including legal costs), or other liabilities, suffered in any manner or caused directly to DAGESH GROUP as a consequence of the client’s breach of or non-compliance with these terms and conditions.
4. Security
4.1 The Client acknowledges that DAGESH GROUP cannot control and offers no suggestions, warranties, or conditions regarding the security or content of information passing through its communication network and the Internet or through the Service.
4.2 The Client acknowledges that services are available through the Internet, and although DAGESH GROUP will do everything in its power to maintain information security, it cannot guarantee that information the Client receives or sends using the Services will be permanently secure.
5. Third-Party Connections
5.1 The Service may be used by the Client to discover various information displayed by DAGESH GROUP on the WEB, to connect with worldwide websites, and the Client undertakes to respect the usage policies applicable on those sites. The Client accepts the fact that DAGESH GROUP does not control these sites, is not responsible, and assumes no obligation regarding other sites, any links from other sites, or their content.
5.2 Any inclusion of links to other sites or networks is made solely for the Client’s assistance and does not imply DAGESH GROUP’s endorsement of material available on or through those sites or networks, nor any association with their operators. The Client accesses those sites and uses their products and services exclusively at their own risk.
5.3 DAGESH GROUP does not guarantee that services or content provided by third-party sources are acceptable and available in any part of Romania. If the Client accesses other content or services from third-party sites, DAGESH GROUP is not responsible for the client’s compliance with local laws or other normative acts in force in those countries.
6. Personal Information
6.1 By accessing this site, you agree that DAGESH GROUP has the right to insert the name and other information regarding the client, resulting from the client’s use of the service, into a computerized database for the following purposes:
a) for DAGESH GROUP’s use of this data for sales and marketing purposes;
b) for the purpose of preventing or detecting crimes or fraud;
c) DAGESH GROUP may provide information collected from the client to other service or product providers who, in DAGESH GROUP’s opinion, might be of interest to the client;
6.2 The purposes for which DAGESH GROUP may use this information and the persons to whom it may be offered are extensively covered in the Privacy Policy.
7. General Provisions
7.1 Modifications to these terms and conditions – DAGESH GROUP may modify these terms and conditions at certain intervals without personally notifying the Client. Such modifications will be brought to the Client’s attention by posting on the website at www.dageshgroup.com. Modifications made in this way are considered accepted by the Client if they continue to use the service after their posting on the website.
7.2 Force Majeure – DAGESH GROUP assumes no responsibility for the inability to comply with obligations provided in these terms and conditions, as a result of any cause beyond its control, including but not limited to fortuitous events, unfavorable weather conditions, action or inaction of the government or other competent authorities for which DAGESH GROUP is not responsible.
7.3 Jurisdiction – This website (excluding third-party websites to which links exist) is controlled by DAGESH GROUP. By accessing this website, the Client agrees that this agreement and any dispute arising therefrom shall be governed by and construed in accordance with the laws of Romania, and the Client submits to the exclusive jurisdiction of the Romanian courts. This website may be accessed from anywhere within Romania and from overseas. DAGESH GROUP makes no representation that the content of this website complies with the laws (including intellectual property laws) of countries other than Romania. If the Client accesses this website from outside Romania, such access is at the Client’s own risk, and the Client is solely responsible for compliance with the laws of the jurisdiction in which the Client is located.
7.4 Confidentiality – DAGESH GROUP does not guarantee that the Client’s use of this site will be confidential. DAGESH GROUP is not responsible for any damage suffered by the Client or another person as a result of confidentiality regarding the Client’s use of this site. Any information the Client discloses on the site may not be secure during its transmission over the Internet. Third parties have the possibility to intercept transmissions made by the Client when using this website. Some services the Client accesses on this site allow them to receive personal information.
8. Client Acceptance of these Terms and Conditions
The Client acknowledges that they have read and accepted these terms and conditions. The Client’s use of the Service constitutes unconditional acceptance of these terms and conditions.
